These Terms & Conditions apply to all services provided by Gawthorne Exterior Cleaning (“the Contractor”, “we”, “us”, “our”) to the client (“you”, “your”, “the Client”). By booking, approving, or allowing works to proceed, you agree to these Terms & Conditions.

 

Services

We provide exterior cleaning services for residential, commercial, and strata properties, including house soft washing, driveway pressure cleaning, patio and hard surface cleaning, roof cleaning, gutter cleaning, solar panel cleaning, exterior window cleaning, and bin cleaning & sanitisation.

All services are carried out with reasonable care, using methods selected by the Contractor based on site conditions, surface suitability, safety, and WHS requirements.

Quotes, Pricing & Variations

All pricing is indicative starting rates only and may vary depending on property size, access, condition, contamination levels, and scope of works.

Quotes are valid for 14 days unless otherwise stated in writing.

Where additional labour, materials, time, or equipment are required due to unforeseen circumstances, site conditions, or changes requested by the Client, reasonable variation charges may apply.

Any variation or additional work outside the agreed scope may be charged separately.

A 5% discount may be applied to bundled or multi-service works at the Contractor’s discretion.

Unless otherwise stated, pricing is exclusive of GST or inclusive of GST as shown on the quotation or invoice, depending on the tax treatment applied to the job.

Payment Terms

Residential invoices are payable within 7 days of completion unless otherwise agreed in writing.

Commercial, strata, and real estate invoices are payable within 7 to 14 days of issue unless otherwise agreed in writing.

The Contractor reserves the right to charge late payment fees and recover debt collection or legal recovery costs where necessary.

Scope of Works

All services are limited strictly to the scope described in the quotation, work order, booking confirmation, or service schedule.

The Contractor is not obligated to perform works outside the agreed scope.

Any additional services requested during or after commencement may be treated as a variation and charged accordingly.

Authority to Proceed

The instructing party warrants that they have full authority to approve works on the property.

The Contractor will not be responsible for disputes between owners, tenants, agents, strata committees, or any other parties regarding authority to approve the works

Access, Site Preparation & Client Responsibilities

The Client must ensure unrestricted access to all work areas, and must provide access to water and power where reasonably required, unless otherwise agreed.

The Client is responsible for ensuring all windows, doors, vents, skylights, electrical outlets, and sensitive areas are securely closed, protected, or isolated before works commence.

The Client must remove or protect vehicles, outdoor furniture, decorations, plants, valuables, fragile items, and any other items that may be affected by the works.

The Client is responsible for ensuring pets, children, tenants, and occupants remain clear of work areas during service operations.

The Client must notify the Contractor of any known leaks, fragile areas, electrical risks, damaged surfaces, or structural concerns before commencement.

If access is not provided, or the site is not adequately prepared, the Contractor may charge a call-out fee, waiting fee, or rescheduling fee.

The Contractor accepts no liability for damage, water ingress, contamination, or related loss arising from failure to adequately prepare the site.

The Client authorises the Contractor to use on-site water and electrical services as reasonably required to complete the works.

The Contractor accepts no responsibility for interruptions, low pressure, utility limitations, or defects associated with the property’s water or electrical systems.

Where applicable, the Client is responsible for disconnecting or isolating rainwater tanks, pumps, filters, or collection systems before roof cleaning or chemical washing commences.

 

Surface Conditions, Pre-Existing Damage & Results

The Contractor accepts no responsibility for pre-existing damage, structural defects, deterioration, or prior surface failure.

This includes, but is not limited to, loose paint, oxidised coatings, aged roofing materials, cracked render, degraded mortar, brittle surfaces, existing leaks, rust stains, oil stains, fading, and embedded contaminants.

High-pressure cleaning and chemical washing may expose pre-existing conditions that were not visible before work commenced.

The Client acknowledges these risks and authorises the works on that basis.

No guarantee is provided for complete stain removal, colour restoration, or a “like new” finish. Results may vary depending on surface age, material, contamination, and environmental exposure.

The Client also acknowledges that exterior cleaning may reveal wear, oxidation, repairs, patching, or colour variation that was previously hidden.

 

Water Ingress

Due to the nature of pressure cleaning and soft washing, water intrusion may occur through pre-existing gaps, failed seals, vents, flashings, windows, doors, skylights, or other structural defects.

The Contractor accepts no liability for internal water ingress or related damage caused by defective seals, poor waterproofing, ageing structures, or pre-existing property conditions.

Roof Work, Height Safety & Weather

Roof cleaning and elevated works are subject to weather, safety, and site conditions.

The Contractor may delay, modify, or cease works where conditions are deemed unsafe or non-compliant with WHS requirements.

Compliance with applicable Work Health & Safety legislation is mandatory and overrides scheduling requirements.

The Contractor is not liable for any loss or delay caused by weather, unsafe access, or site conditions outside its control.

Chemicals, Cleaning Methods & Material Compatibility

Professional-grade cleaning agents and pressure systems may be used as required.

The Contractor accepts no liability for adverse reactions to pre-existing coatings, sealants, low-quality paint systems, or incompatible materials.

While reasonable care is taken to protect surrounding areas, the Contractor is not liable for plant stress, browning, chemical sensitivity, runoff-related staining, drainage overflow, or effects caused by site conditions outside the Contractor’s control.

Cleaning methods are selected at the Contractor’s professional discretion based on safety, surface suitability, and effective results.

Permits, Council Requirements & Additional Charges

The Contractor will take reasonable steps to comply with relevant permits, approvals, and local council requirements necessary to carry out the works.

Where approvals, site information, or permissions are required from the Client, the Client agrees to provide accurate and complete information prior to commencement.

The Contractor will not be held liable for delays or additional costs resulting from incomplete, incorrect, or withheld information provided by the Client or third parties.

Additional charges may apply where conditions differ between service areas.

Public holidays, after-hours work, urgent service requests, or difficult access may incur additional fees, which will be advised where possible before commencement.

Cancellations & Postponements

Cancellations within 24 hours of scheduled works may incur a call-out fee.

Weather delays, safety concerns, access restrictions, or circumstances beyond reasonable control may result in rescheduling without penalty.

If the Contractor attends site and works cannot proceed due to access issues, unsafe conditions, or lack of preparation, additional charges may apply.

Photography & Property Records

The Contractor may capture before-and-after images for compliance, quality assurance, training, and marketing purposes.

No identifying tenant or sensitive property information will be disclosed without consent.

Clients may request in writing that images of their property not be used for marketing purposes prior to commencement of works.

Defects, Complaints & Rectification

Any concerns must be reported within 48 hours of completion.

The Contractor reserves the right to inspect the site and determine whether rectification is required.

No refunds are issued once work has been completed and accepted, except where required by law.

Liability & Indemnity

The Contractor maintains current public liability insurance as required for commercial operations.

To the maximum extent permitted by law, liability is limited strictly to the value of the services supplied.

The Contractor is not liable for indirect, consequential, or financial losses including, but not limited to, loss of rent, tenant disruption, property devaluation, business interruption, or lost opportunity.

The Client indemnifies the Contractor against any claims arising from incorrect instructions, withheld information, lack of authority to proceed, or failure to comply with site preparation requirements.

Privacy

Any personal information collected is used only for booking, quoting, invoicing, service delivery, and related business administration.

We will not disclose identifying client, tenant, or sensitive property information except where required by law or with consent.

Acceptance by Email, Text or Booking Confirmation

Acceptance of quotations, work orders, estimates, booking confirmations, or approval provided by email, SMS, electronic signature, written confirmation, or by allowing works to commence constitutes acceptance of these Terms & Conditions.

Entire Agreement

These Terms & Conditions, together with the service schedule, quotation, or work order, constitute the entire agreement between the parties and override all prior discussions or informal arrangements.

Nothing in these Terms & Conditions excludes or limits any rights under the Australian Consumer Law. Consumer guarantees cannot be excluded, and unfair contract terms in standard form contracts are regulated under Australian law.

Governing Law

These Terms & Conditions are governed by the laws of Western Australia.
